I cant speak for them, but from what I read, the site discourages people from breaking the regulations of land managers. If such a  cache is placed, the sponsors should not approve it. If they do, and someone reports it, then the site owner can remove it. The site does say that all caches need to be legal (as in all land management rules be followed, laws followed etc.).

Of course, it only takes a few minutes to get registered and sponsored... by
the sounds of it. So it really would not make a difference if there was open
viewing of caches or not! If someone wanted to get on the site just for the
reason of vandalizing caches, it wouldnt take much effort. Just register and
in a few minutes.. you have your sponsors and you are on your way to a
future in vandelizing tc.com caches! :) LOL
